What is covered by the limited warranty?
This 1-year limited warranty covers defects in materials and workmanship in your TRIA Hair Removal Laser and TRIA Skin Perfecting Blue Light if you purchased it from an authorized partner or directly from the manufacturer (TRIA Beauty). Your 1-year limited warranty is valid for you alone, the original purchaser and cannot be transferred.

What is not covered by this limited warranty?
This limited warranty is effective only if the TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light is purchased and used in the United States. This limited warranty does not cover damage, defects, or failure caused by abuse or misuse; improper care; impact or insertion of foreign objects; vandalism; improper storage; improper or incorrectly performed maintenance or repair; application of harmful chemicals; Acts of God, fire, or water; abrasives; negligence; failure to follow manufacturer's instructions; loss of the TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light; normal wear and tear; alteration; overuse; professional use; or commercial use.

How long does this limited warranty last?
The limited warranty begins on the date of purchase and expires one year later. The warranty period is not tolled or extended for any period during which the TRIA Hair Removal Laser (or any parts thereof) or TRIA Skin Perfecting Blue Light is in repair, or if they are replaced by TRIA Beauty during the warranty period.

What will TRIA Beauty do if my TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light is defective?
If you discover a covered defect in your TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light before the one-year warranty period expires, contact Customer Care at 1-877-321-TRIA (8742) to initiate the return process.

If defective, we will repair or replace your TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light. Customer Care will contact you and keep you updated on the progress of repairs and return shipments.

If we find that the defect in your TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light is not covered under this limited warranty, we will notify you with service alternatives that are available to you on a fee basis.

If we find that your TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light is not defective, we will notify you and return the original product to you.

All Limited Warranty services must be authorized and performed by TRIA Beauty or a service provider authorized by TRIA Beauty.

Warranty Limitations and Disclaimers…
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION).

TRIA BEAUTY'S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN THE TRIA HAIR REMOVAL LASER OR TRIA Skin Perfecting Blue Light, AND YOUR REMEDIES FOR THE BREACH OF THIS LIMITED WARRANTY IS LIMITED SOLELY TO THE REPAIR AND REPLACEMENT OF YOUR TRIA HAIR REMOVAL LASER OR TRIA SKIN PERFECTING BLUE LIGHT AS SET FORTH IN THIS WARRANTY STATEMENT.

THE EXPRESS LIMITED WARRANTY SET FORTH ABOVE IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIA BEAUTY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF USE OF THE TRIA SYSTEM, COST OF ANY SUBSTITUTE EQUIPMENT, THE CLAIMS OF THIRD PARTIES, OR DAMAGE TO PROPERTY. THIS LIMITATION DOES NOT APPLY TO CLAIMS FOR PERSONAL INJURY CAUSED BY A DEFECT IN THE TRIA HAIR REMOVAL LASER OR TRIA Skin Perfecting Blue Light. THESE WARRANTY TERMS, CONDITIONS AND LIMITATIONS ALLOCATE THE RISKS OF PRODUCT FAILURE BETWEEN TRIA BEAUTY AND YOU, THE PURCHASER OF THE TRIA SYSTEM. THIS ALLOCATION IS RECOGNIZED BY BOTH PARTIES AND IS REFLECTED IN THE PRICE OF THE TRIA HAIR REMOVAL LASER. BY USING THE TRIA HAIR REMOVAL LASER OR TRIA Skin Perfecting Blue Light YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, CONDITIONS AND LIMITATIONS, UNDERSTAND THEM, AND ARE BOUND BY THEM.

Product Changes…
TRIA Beauty reserves the right to make changes and improvements to its products without incurring any obligation to incorporate such improvements in products previously sold.

Disputes…
This warranty is governed by the laws of the State of California, without regard to principles of conflicts of laws, and applicable United States federal law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. YOU AGREE TO SUBMIT ANY CLAIM, DISPUTE, OR CONTROVERSY (REGARDLESS OF THE FORM OR TYPE OF ACTION) AGAINST US TO ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM UNDER ITS CODE OF PROCEDURE THEN IN EFFECT (available at http://www.arb-forum.com or via telephone at 1-800-474-2371). Except to the extent otherwise required by law, you agree that the arbitration proceedings will take place exclusively in Pleasanton, California, USA. You may be entitled to file suit under state laws without submitting your claim to arbitration first. Information on arbitration may be obtained from, and a claim may be filed with, the National Arbitration Forum at P.O. Box 50191, Minneapolis, MN 55405-0191 USA.

Time for Filing Claims
Any claim for breach of this limited warranty must be commenced by within twelve (12) months following the original purchase of the TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light.

No Other Warranties
Unless modified in a writing signed by both parties, these warranty terms, conditions and limitations are understood to be the complete and exclusive agreement between the parties, superseding all prior agreements and representations, oral or written, and all other communications between the parties relating to the subject matter of these warranty terms. No employee of TRIA Beauty or any other party (including without limitation distributors, dealers, and retailers) is authorized to make any warranty in addition to those made herein.

Miscellaneous Terms
As used in this contract, "we" and "us" refers to TRIA Beauty. "You" refers to the original purchaser of the TRIA Hair Removal Laser or TRIA Skin Perfecting Blue Light. A waiver of strict compliance with any term herein shall not be deemed a continuing waiver or waive any other terms or conditions. We shall be excused from performance to the extent of any delay or inability to perform arising due to weather events, disasters, acts of terror, governmental action or regulation, labor or materials shortages or disputes, or other circumstances not under our control. If any term herein is illegal, invalid, or unenforceable, then such term shall be ignored, but the remaining terms and conditions shall remain in effect.

3. Is harassing, threatening, abusive, inflammatory or otherwise objectionable, including Content used to harass, stalk or threaten a person;
4. Is unlawful or that could facilitate the violation of any applicable law, regulation or governmental policy, or the rights of any third party;
5. Offers or disseminates any fraudulent goods, services, schemes or promotions, including any "make money fast" schemes or pyramid schemes;
6. Is libelous, defamatory, or knowingly false or misrepresents another person;
7. Seeks to impersonate any person or entity, or falsely state or otherwise represent your affiliation with a person or entity;
8. Promotes an illegal or unauthorized copy of another person's copyrighted work, or infringes upon the intellectual property rights of any third party, including the copyrights, trademarks, trade names, trade secrets or patents of such third party, or is posted without the express permission of the owner(s) of such rights;
9. Includes any material that is encrypted or that involves the transmission of "junk mail," unsolicited mass mailing or spamming, or unauthorized advertising;
10. Is harmful to TRIA Beauty or any other party's systems and networks, including any transmissions which may damage, interfere with, surreptitiously intercept, or expropriate any system, program, data or personal information;
11. Violates any obligation of confidentiality or violates the privacy, publicity, moral or any other right of any third party; and
12. Consists of any other Content that TRIA Beauty in its sole discretion deems to be Unacceptable Content.

YOU HEREBY AGREE TO RELEASE TRIA BEAUTY, ITS AFFILIATES AND THIRD-PARTY SERVICE PROVIDERS, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED ("CLAIMS"), ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THIS SITE AND ITS SERVICES. ELECTRONIC COMMUNICATIONS
When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you be email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

JURISDICTION AND GOVERNING LAW
TRIA Beauty makes no representation that the Site Information, the Services or products offered through the Site are appropriate, available or legal in any particular location. Those who choose to access the Site Information, the Services and products offered through the Site do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree that this Agreement, for all purposes, shall be governed and construed in accordance with the laws of the State of California and any action based on or alleging a breach of this Agreement must be brought in a state or federal court located in northern California. In addition, both parties agree to submit to the exclusive personal jurisdiction and venue of such courts.


TRIABEAUTY.COM IS FOR USE IN THE UNITED STATES
The Site is hosted in the United States and is intended for users located in the United States. If you are a non-U.S. user of the Site, by visiting the Site, using its Services and/or providing us with any Content, you agree to comply with all applicable laws governing the Site, its Services, online conduct and acceptable Content. You further agree to comply with all applicable laws regarding the transmission of data exported from the United States or the country in which you reside.

TRADEMARK NOTICE
The TRIA, TRIA Beauty and the Site names, logos, and other identifying marks are the property of TRIA Beauty. Other featured words or symbols, used to identify the source of merchandise or services, may be the trademarks of their respective owners.

clearance authority statement
By ordering goods from Tria Beauty, I hereby authorize a licensed Canadian customs broker chosen by Tria Beauty to act as my agent, and to transact business with Canada Customs Revenue Agency (CCRA) to clear my merchandise, account for applicable duties and taxes, to return merchandise to Landmark Global and prepare and submit refund claims on my behalf for any merchandise that I return.

I understand that CCRA will send any refund of duties and taxes that were paid on the returned merchandise to the broker, and that I will obtain the refund directly from Tria Beauty. In this connection, I also authorize the customs broker to endorse any refund check issued by CCRA in my name, so that Tria Beauty can be reimbursed. I also waive my need for any receipt of this transaction which may include classification of goods, transaction number, and a breakdown of duties and taxes.
